We the undersigned respectfully request that Justice Antonin Scalia recuse himself from Wal-Mart Stores v. Dukes due to the fact that his son, Eugene Scalia, is a partner at Gibson Dunn, the law firm representing Walmart in the case.
In the case, Walmart seeks decertification of a class-action suit brought against it by more than million women. This is the largest class-action lawsuit in the history of the United States, where current and former Walmart associates claim that the largest retailer in the world systematically discriminated against women.
Justice Antonin Scalia’s son, Eugene Scalia, is a partner in the law firm Gibson Dunn, which is representing Walmart in this case. Gibson Dunn has represented Walmart in four class action wage and hour law suits since 2007. Eugene Scalia also co-leads Gibson Dunn’s Labor and Employment practice group.
Eugene Scalia has a history representing Walmart and its interests, including representing the company in court alongside the current head of the Dukes case for Gibson Dunn, and as counsel for the Retailers Industry Leaders Association in two key cases for Walmart.
His firm also represented President Bush before the Supreme Court in Bush v. Gore, where Justice Scalia ruled favorably for the plaintiff.
Eugene Scalia’s connection to the plaintiff and to one of the Justices hearing the case, his father, Antonin Scalia, raises serious concerns and at a minimum, the appearance of impropriety. Worse, these substantial and long-standing facts erode public confidence in judicial impartiality and the court’s integrity.
